$client_name and everyone on its site have duty of care obligations under the Work Health and Safety legislation.
Under this duty of care, $client_name must provide safe workplaces and eliminate potential hazards in the workplace. This duty of care also includes taking reasonable precautions to ensure all workers are fit for work.
The use of alcohol and drugs in the workplace presents many problems.
- If you are drowsy or your coordination has been impaired, you are not competent to operate machinery or equipment
- You are putting yourself, your workmates and $client_name at risk of prosecution and/or fines.
- If you are injured at work whilst affected, your workers compensation may be ruled void.
- Possession, consumption distribution or sales of illicit drugs may lead to prosecution.
- If you damage property while affected, you are liable to repair or replace the property and may face instant termination.

Breaches
The following will be regarded as a breach of policy and evidence that a individual is unfit for work:
- Any use of alcohol or drugs which results in the potential impairment of an individuals fitness for work
- Any positive alcohol or drug test
- Any refusal, falsification or adulteration of any alcohol or drug test.
- Sale or supply of alcohol or drugs on site or during working hours
- Consumption or possession of alcohol and/or drugs at work
